The next most important documents after guidance notes are Approved Codes of Practice, (ACOPs). Again there are many of these but they, contrary to popular belief, are not legal documents. They do, however, show the way a particular piece of legislation can be complied with.
I like to use an analogy to explain ACOPs. They are like the Highway Code which again is not a legal document. The law is laid down in the Road Traffic Acts 1988 and 1991 and the highway code clarifies the position so that motorists can understand their legal obligations.
An Approved Code of Practice can be quoted in court to support the prosecution of a company charged with an offence under the Health and safety at Work Act.
